These Terms of Service apply to the FlashNFunky website, subscription plans, Sticker Creator, Stream Slider and related services provided through flashnfunky.com.

By creating an account, purchasing a subscription or using a FlashNFunky tool, you agree to these Terms of Service. If you do not agree, you must not use the services.

1. About FlashNFunky

FlashNFunky provides online design, printing and live-streaming tools, including:

  • FlashNFunky Sticker Creator
  • FlashNFunky Stream Slider
  • Member dashboards and private overlay links
  • Related updates, themes, effects and supporting services

In these terms, “FlashNFunky”, “we”, “us” and “our” refer to FlashNFunky. “You” and “your” refer to the person or business accessing or purchasing our services.

FlashNFunky operates from New South Wales, Australia.

2. Account Registration

You may need to create an account to purchase a subscription or access certain tools.

You agree to:

  • Provide accurate and current information.
  • Keep your login details secure.
  • Not share your account with another person or business unless your plan expressly allows it.
  • Notify us if you believe your account has been accessed without permission.
  • Accept responsibility for activity performed through your account.

You must be at least 18 years old or have permission from a parent or legal guardian to create a paid account.

We may suspend access while investigating suspected unauthorised access, misuse or a security issue.

3. Subscription Plans

Some FlashNFunky tools require an active paid subscription.

The price, billing period, trial period and features included with a subscription will be displayed before purchase. Different subscriptions may provide access to different tools.

Unless stated otherwise, a subscription is licensed to one registered user or business and is not transferable.

We may introduce, remove or change subscription plans. Any price change affecting an existing subscription will be communicated before it takes effect and handled in accordance with applicable law.

4. Automatic Renewal and Payments

Where automatic renewal is selected or required by a plan, your subscription will renew at the end of each billing period until cancelled.

By starting an automatically renewing subscription, you authorise our payment provider to charge your selected payment method for:

  • The subscription price shown at registration.
  • Any applicable taxes.
  • Future recurring payments until the subscription is cancelled.

You are responsible for keeping your payment details current.

If a payment fails, we may retry the payment and temporarily restrict access to paid features. Access may be restored once payment is successfully completed.

We do not directly store complete credit card details. Payments are processed through the payment provider displayed during checkout.

5. Trials and Promotional Offers

A subscription may include a free or discounted trial.

The trial length and the amount payable when it ends will be displayed during registration. If automatic renewal applies, the subscription will automatically become paid when the trial ends unless you cancel before the renewal time.

Trial offers may be restricted to new customers and may not be repeatedly claimed by creating additional accounts.

Promotional offers and discount codes may have separate conditions, expiry dates or eligibility requirements.

6. Cancelling a Subscription

You may cancel an automatically renewing subscription through your FlashNFunky account or by contacting us.

Cancellation prevents future renewal charges. Unless otherwise required by law, access will generally continue until the end of the billing period already paid for.

Deleting the tool, removing an OBS Browser Source or ceasing to use the service does not automatically cancel a subscription.

You should cancel before your next renewal date if you do not want the next payment to be processed.

7. Refunds and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Refunds are not normally provided for:

  • Change of mind.
  • Failure to cancel before a renewal date.
  • Accidental purchases caused by information entered by the customer.
  • Failure to use an available subscription.
  • Problems caused by unsupported equipment, software or third-party services.

However, you may be entitled to a refund, replacement, correction or other remedy where required under the Australian Consumer Law, including where a service has a major problem or does not meet an applicable consumer guarantee.

Please contact us if you believe there is a fault with the service or an incorrect payment.

8. Sticker Creator

The Sticker Creator assists users with preparing images, backgrounds, layouts, sticker sheets, cutlines and related production files.

You remain responsible for reviewing all files before printing, cutting, manufacturing or supplying a finished product.

In particular, you must check:

  • Artwork dimensions and resolution.
  • Spelling and content.
  • Colours and transparency.
  • Cutline placement and offsets.
  • Bleed, margins and spacing.
  • Compatibility with your printer, cutter and production software.
  • The final preview and downloaded output.

Screen colours may differ from printed colours because of monitor settings, colour profiles, materials, inks, printers and production methods.

Automated background removal, image enhancement and cutline generation may not be perfect. Fine details, hair, transparent objects, shadows and low-resolution artwork may require manual correction.

FlashNFunky is not responsible for production costs or wasted materials resulting from files being printed or cut without first being reviewed and tested, except where liability cannot legally be excluded.

We recommend producing a small test before beginning a large print or cutting run.

9. Stream Slider

The Stream Slider allows members to create and control visual overlays for OBS and compatible streaming services.

Features may include:

  • Product sliders
  • Titles and text areas
  • Animated text
  • Tickers
  • Images and GIFs
  • Tables
  • Themes and layouts
  • Sound and visual effects
  • Private OBS overlay links
  • Live editing controls

You are responsible for testing your overlay before starting a live stream.

Performance can be affected by your device, browser, internet connection, OBS settings, image sizes, GIF complexity and third-party streaming platform.

We do not guarantee that every browser, device, OBS version, plugin, streaming service or screen resolution will be supported.

Private OBS links

Your Stream Slider overlay may be accessed through a private URL or key.

You must:

  • Keep the private URL secure.
  • Avoid publishing it publicly.
  • Regenerate or replace it if you believe it has been exposed.
  • Remove it from computers you no longer control.

Anyone with access to the private overlay URL may be able to display your overlay. FlashNFunky is not responsible for access caused by you sharing or exposing the URL.

Uploaded stream content

You are responsible for all products, names, images, GIFs, logos, sounds, text and other content displayed through your Stream Slider.

The Stream Slider is a presentation tool only. It does not independently operate Whatnot giveaways, select winners, collect payments or verify the legality of promotions.

You must ensure that your stream content and activities comply with the rules of Whatnot, OBS, your streaming platform and applicable laws.

10. Automated and AI-Generated Information

Some FlashNFunky features may use automated processing or artificial intelligence to analyse, enhance, identify or name content.

Automated information may be incomplete or incorrect. For example, a product image may be assigned the wrong name, year, set, character, player or description.

You must review and correct automated information before displaying, publishing, selling or relying upon it.

FlashNFunky does not guarantee the accuracy of AI-generated or automated content.

11. User Content and Intellectual Property

You retain ownership of content you upload to FlashNFunky.

By uploading content, you grant us a limited licence to store, process, resize, display and transmit it only as reasonably necessary to provide the requested service.

You confirm that:

  • You own the uploaded content or have permission to use it.
  • Its use does not infringe copyright, trademark, privacy or other legal rights.
  • It is not unlawful, deceptive, defamatory or harmful.
  • You have permission to display any personal information, names or photographs it contains.

You are responsible for claims arising from content you upload or display.

We may remove content that appears unlawful, harmful, infringing or inconsistent with these terms.

12. FlashNFunky Intellectual Property

The FlashNFunky website, software, interfaces, source code, branding, layouts, original themes, documentation and related materials remain the property of FlashNFunky or their respective licensors.

An active subscription gives you a limited, revocable, non-exclusive and non-transferable right to use the relevant service for its intended purpose.

You must not:

  • Copy, resell, sublicense or distribute the service.
  • Share paid access with unauthorised users.
  • Attempt to bypass subscriptions or access controls.
  • Reverse engineer or extract protected source code except where expressly permitted by law.
  • Remove FlashNFunky ownership notices.
  • Use our systems to create a competing hosted service.
  • Use automated systems to overload, scrape or interfere with the service.

Your own finished designs and stream layouts remain yours, subject to any rights attached to third-party assets you use.

13. Acceptable Use

You must not use FlashNFunky services to:

  • Break any applicable law.
  • Infringe intellectual property or privacy rights.
  • Distribute malware or harmful code.
  • Access another user’s account or private overlay.
  • Interfere with the operation or security of the website.
  • Misrepresent a random draw, giveaway or competition.
  • Display unlawful, abusive, deceptive or seriously harmful content.
  • Conduct gambling, raffles or purchase-based prize activities where prohibited.
  • Violate the policies of a streaming, selling or payment platform.

We may suspend or terminate access where we reasonably believe these conditions have been breached.

14. Saved Content and Backups

We may provide features for saving layouts, tables, settings, files or presets. These features are provided for convenience and should not be treated as permanent backup storage.

You should retain your own copies of important artwork, source images, product information and settings.

We may need to remove corrupted, unlawful or technically incompatible data. We will take reasonable care but cannot guarantee that every saved item can always be recovered.

15. Third-Party Services

FlashNFunky may interact with or depend upon third-party services such as:

  • WordPress
  • WooCommerce
  • Paid Member Subscriptions
  • Stripe or other payment providers
  • OBS Studio
  • Whatnot
  • Dropbox
  • External APIs, fonts, libraries or hosting providers

These services have their own terms, privacy practices, availability and technical requirements.

FlashNFunky is not owned, endorsed or operated by Whatnot or OBS unless expressly stated otherwise.

We are not responsible for a third party changing, restricting or discontinuing its service. Where practical, we may update FlashNFunky tools to maintain compatibility, but continued compatibility cannot be guaranteed.

16. Availability, Maintenance and Updates

We aim to keep FlashNFunky services available and functioning, but uninterrupted or error-free access cannot be guaranteed.

Temporary interruptions may occur because of:

  • Maintenance and updates.
  • Hosting or internet failures.
  • Security incidents.
  • Third-party service outages.
  • Browser, WordPress or OBS updates.
  • Events outside our reasonable control.

We may add, modify or remove features to improve security, compatibility, usability or performance.

Where a paid service becomes unavailable for a significant period, we will provide any remedy required under applicable law.

17. Support

Reasonable support may be provided for current versions of FlashNFunky tools.

Support does not necessarily include:

  • General WordPress administration.
  • OBS installation or computer repair.
  • Custom design work.
  • Third-party platform support.
  • Recovery of content deleted by the user.
  • Compatibility with unsupported or heavily modified systems.
  • Custom development outside the advertised subscription features.

Additional work may be quoted separately.

18. Suspension and Termination

We may suspend or terminate access if:

  • Required subscription payments remain unpaid.
  • You seriously or repeatedly breach these terms.
  • Your use creates a security or operational risk.
  • You attempt to bypass membership controls.
  • We are legally required to restrict access.

Where appropriate, we will give you an opportunity to correct the issue before termination.

Termination does not remove payment obligations that arose before termination. It also does not affect rights or remedies that must continue under applicable law.

19. Privacy

Personal information is handled in accordance with our Privacy Policy.

Information may be processed by service providers where necessary for account management, payments, hosting, file processing, security and delivery of the services.

You must not upload sensitive personal information unless it is necessary and you have permission to do so.

20. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, FlashNFunky does not guarantee that:

  • Every automated result will be accurate.
  • The services will suit every production or streaming workflow.
  • Third-party integrations will remain continuously available.
  • Use of the tools will increase sales, viewers, engagement or revenue.

To the maximum extent permitted by law, FlashNFunky will not be liable for indirect or consequential loss arising from use of the services, including lost profits, missed sales, interrupted streams or production undertaken without checking the output.

Nothing in this section excludes liability, consumer rights or remedies that cannot legally be excluded or limited.

21. Changes to These Terms

We may update these Terms when features, subscriptions, third-party services or legal requirements change.

The updated version will be published on this page with a revised “Last updated” date.

Where a change materially affects an existing paid subscription, we will take reasonable steps to provide notice before the change takes effect.

Continuing to use the service after updated terms take effect means you accept the revised terms.

22. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and FlashNFunky submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights you have under applicable consumer law.
